In 1803, Chief Justice John Marshall wrote the most important sentence in American constitutional law: any law repugnant to the Constitution is null and void. He wrote it in Marbury v. Madison - the decision that established the Supreme Court's authority to strike down unconstitutional legislation - and it has been the foundational principle of American constitutional law ever since.

The Tenth Amendment's reservation of powers that Wickard v. Filburn effectively erased by holding that a farmer's personal wheat consumption was interstate commerce.

This book does not traffic in conspiracy or legal theory untethered from the record. Every argument is anchored in named constitutional provisions, named Supreme Court decisions, named federal statutes, and the documented human cost of the gap between what Marshall promised and what the republic has delivered. It presents the complete honest picture - including where courts have upheld laws this book argues are unconstitutional, and what the legal arguments on both sides actually say.
